Our Responsibilities
We will provide SEO services that adapt to the evolving needs of the SEO industry. We reserve the right to adjust our methods and deliverables as needed to best serve your business. Any significant changes will be communicated in writing.
We do not guarantee specific search result rankings, domain ratings, or similar metrics. Search engine algorithms change over time, and we will perform our services to the best of our abilities within the current industry standards.
Service Duration
Our services begin upon receipt of payment and include a mandatory 30-day no-cancellation term. After this period, the services continue on a rolling month-to-month basis until canceled as described under “Cancellation of Services.”
Cancellation of Services
After the mandatory no-cancellation term, either party can cancel the services with a minimum of 10 days' notice, provided all outstanding payments have been made, except those disputed in good faith.
Cancellations can be made by emailing support@peakgrowth.biz or using the Stripe cancellation link provided. Once payment has been processed for the upcoming month’s services, no refunds will be issued for that month.
Immediate termination is allowed if the other party:
Commits a breach of this agreement and fails to remedy it within 14 days of notice.
Enters bankruptcy, liquidation, or has a receiver appointed over its assets.
Upon termination, services and payments will continue during any notice period, except under the immediate termination conditions. Any outstanding payments for additional services will be due immediately.
Warranties
You warrant to:
Pay all fees on time.
Comply with all applicable licenses, laws, and regulations.
Use our services legally and not for unauthorized purposes.
Avoid disrupting other users or spreading harmful software.
Not solicit our employees or contractors during the contract term and for 12 months after termination.
We warrant that:
Our services will be performed professionally and in line with industry standards.
No other warranties, express or implied, are made regarding this agreement or the services, including expectations of specific rankings or profitability.
Liability
We are not liable for factors beyond our control, such as changes in search engine algorithms or policies. We do not guarantee specific search engine rankings and are not responsible for any resulting negative impacts.
We are not liable for indirect, special, or consequential losses. In the event of a breach by us, your remedies are limited to damages, not exceeding the fees paid in the preceding six months.
You agree to indemnify us against damages and claims arising from your actions or breaches of this agreement. We are not liable for losses related to data, profit, or revenue.
Indemnification
You agree to defend, indemnify, and hold us harmless from claims, damages, and expenses arising from your breach of this agreement. If we face any legal action due to your breach, you will defend us at your expense.
Force Majeure
Neither party is liable for delays or failures due to causes beyond their control, such as natural disasters, strikes, power failures, or acts of terrorism.
Jurisdiction and Interpretation
This agreement is governed by the laws of Maine. Any disputes will be resolved in the courts of Portland, Maine. The terms are clear and unambiguous, and no third party may interpret them differently.
Confidentiality
Both parties agree to keep any disclosed confidential information secure and only use it to fulfill their obligations under this agreement. Confidential information will not be shared with third parties without written consent.
